Houston Wrongful Death Attorney

If a member of your family has died because of someone's negligence or violence, we urge you to call Houston Wrongful Death Attorney Robert Rodriguez as soon as possible for a free consultation. Wrongful death actions are complicated and can raise many legal issues. They can give rise to hospital liens, as well as Medicare and Medicaid liens. (It is important to note that these liens apply to the survivorship cause of action but not the death action.)

Another issue which might arise is called a Bystander Cause of Action. Gross negligence and punitive damages are sometimes also involved in death claims. These are just a few of the many issues that can arise from a wrongful death cause of action and that require consultation with an expert who can explain things in simple language and can answer questions patiently. Mr. Rodriguez never tries to pressure anyone into filing a lawsuit, but he does want to make sure you know your legal options while you still have time to make choices.

The Texas Wrongful Death Act

The Texas Wrongful Death Act specifies that only the spouse, parents, and children of the deceased have a right to bring a claim in a death case. Because there are multiple claimants and because relationships to the deceased must be proven, many different issues can arise, such as proving a marriage, proving paternity, dealing with conflicts of interest between claimants, and finding or proving the death of potential beneficiaries in order to include or exclude them from the claim.

Who is Entitled to Bring a Wrongful Death Claim?

The Texas Wrongful Death Act provides two causes of action. The death action allows compensation for funeral expenses, loss of household services, maintenance, support, advice, counsel, consortium and companionship. Also included is the loss of the financial contributions which would have been made by the deceased to the survivors had he or she lived and been able to work to retirement.

The second cause of action available under the Texas statute is called a survivorship action. The damages available here include the medical expenses incurred by the deceased between the time of injury and death, the pain and suffering endured by the deceased, and the mental anguish suffered by the deceased.
